1.1 Data Controller

DigitalLayoutPro, registered at Calle Feria 50, 41002 Seville, Spain, acts as the data controller for all personal data processed through this website. Contact: [email protected].

1.2 Data Collection

We collect personal data solely for the purpose of executing requested web design services. Data categories include: name, email address, phone number, company name, and project specifications submitted through our contact form.

1.3 Legal Basis for Processing

Personal data is processed under Article 6(1)(b) of the GDPR — necessary for the performance of a contract or pre-contractual measures taken at the data subject's request. We also rely on Article 6(1)(a) for marketing communications, requiring explicit consent.

1.4 Data Retention

Personal data is retained for a maximum of 24 months after the last communication. Project-related data is retained for 5 years in compliance with Spanish commercial record-keeping obligations.

1.5 Data Sharing

Personal data is not sold, traded, or transferred to third parties except: (a) trusted service providers who assist in operating our website and servicing clients, bound by confidentiality agreements; (b) when required by law or to protect our rights.

1.6 Data Subject Rights

Terms of Service

Contractual Framework

2.1 Scope of Services

DigitalLayoutPro provides web design, layout optimization, and conversion-focused digital layout services as described on our services page. All services are delivered according to the specifications agreed upon in the project proposal.

2.2 Project Proposals & Acceptance

A project is considered initiated upon client acceptance of the written proposal and receipt of the initial payment. Proposals are valid for 30 days from the date of issue. DigitalLayoutPro reserves the right to modify proposals after this period.

2.3 Payment Terms

50% of the total project fee is due upon acceptance of the proposal. The remaining 50% is due upon delivery and prior to final file handover. Invoices are payable within 14 days. Late payments incur a 2% monthly surcharge.

2.4 Revisions

Each project includes up to 2 rounds of revisions at no additional cost. Additional revision rounds are billed at €75/hour. Revision requests must be submitted in writing within 7 days of delivery.

2.5 Intellectual Property

Upon full payment, all intellectual property rights for the delivered layouts and designs transfer to the client. DigitalLayoutPro retains the right to display completed work in portfolio materials unless otherwise agreed in writing.

2.6 Limitation of Liability

DigitalLayoutPro's total liability shall not exceed the total project fee paid. We are not liable for indirect, incidental, or consequential damages. We are not responsible for third-party platform changes affecting delivered layouts.

2.7 Termination

Either party may terminate this agreement with 14 days written notice. In the event of termination, the client is responsible for payment of all work completed up to the termination date. Deposits are non-refundable once work has commenced.

2.8 Governing Law

This agreement is governed by the laws of Spain. Any disputes shall be resolved in the courts of Seville, Spain.

3.1 What Are Cookies

Cookies are small text files stored on your device when you visit a website. They help the site remember your preferences and improve your browsing experience.

Refund Policy

Consumer Rights Directive

4.1 Digital Services Exemption

As DigitalLayoutPro provides digital services (web design and layout development), the standard 14-day withdrawal period under EU consumer law does not apply once services have been delivered with the consumer's prior consent and acknowledgement that they lose the right of withdrawal.

4.2 Pre-Delivery Cancellation

If you cancel a project before any work has commenced, you are entitled to a full refund of any deposits paid. Cancellation must be communicated in writing to [email protected].

4.3 Partial Work Refund

If a project is cancelled after work has begun but before delivery, DigitalLayoutPro will retain payment for all work completed to date. A detailed breakdown of hours and deliverables will be provided. Any overpayment relative to work completed will be refunded within 14 business days.

4.4 Post-Delivery Disputes

If delivered layouts materially differ from the agreed specifications in the project proposal, you must notify DigitalLayoutPro in writing within 7 days of delivery. We will rectify any discrepancies at no additional cost. If rectification is not possible, a partial refund may be issued at our discretion.

4.5 Refund Process

Refund requests are processed within 14 business days of approval. Refunds are issued via the original payment method. Processing times may vary depending on your financial institution.

4.6 Non-Refundable Items

The following are non-refundable: domain registration fees, third-party software licenses purchased on the client's behalf, and hosting setup fees once servers have been provisioned.
